[LOCAL POLICIES & REGULATIONS] You are here: Home > Local Policies & Regulations Regulation 1 The Benton Clean Air Agency is a municipal corporation that has the ability to enact its own local regulation. This regulation exists in conjunction with, but cannot be less stringent than, state and federal air quality rules. The local Regulation is called Regulation 1, and consists of the locally applicable rules which apply throughout Benton County. Regulation 1 is subject to public comment prior to any changes being made.

Fugitive Dust Policy In 1995, the Clean Air Agency established a committee to determine a policy for the enforcement of dust regulations in the urban areas. Dust that moves off of property and impacts others is called "fugitive dust" and is regulated by state law. The committee was composed of community members including health officials, agriculture, construction industry, government officials, and other community members. The final draft of the policy was put into effect in June 1996. A downloadable copy of the Urban Fugitive Dust Policy PDF is available. Paper copies are $3.00 per copy. The BCAA also has guidelines and forms for submitting a dust control plan (PDF DOC). Applicable State Laws In addition to local regulations and policies, the BCAA is also responsible for enforcing several Washington State laws, both from the Washington Administrative Code (WAC) and the Revised Code of Washington (RCW).
